Some leaders labeled it a move towards creating a “police state,” while others claimed it was an attempt to establish a “democracy without opposition.” Congress MP Manish Tewari argued that the bill goes against the basic structure of the Constitution, while Rahul Gandhi said it marks a return to the medieval era.
The political uproar erupted on Wednesday when Union Home Minister Amit Shah introduced the Constitution (130th Amendment) Bill, 2025 in the Lok Sabha, along with the Jammu and Kashmir Reorganization (Amendment) Bill, 2025 and the Union Territory Governance (Amendment) Bill, 2025. These bills seek to create a law enabling the removal of a Prime Minister, Chief Minister, or Minister facing charges of corruption or serious crimes and held in continuous custody for 30 days. The opposition reacted sharply, calling the move dangerous for democracy.

Rahul Gandhi strongly criticized the Modi government over the newly proposed bills, calling them a step that drags India back by centuries. Commenting on the controversial Constitution Amendment Bill, he said, “The BJP’s new legislation is creating a huge uproar. We are going back to the medieval era when a king could remove anyone at will. If he disliked someone’s face, he could have them arrested through the ED, and within 30 days even a democratically elected representative could be thrown out of office.”
Gandhi warned that such laws undermine democracy and set a dangerous precedent, comparing the move to absolute monarchy rather than constitutional governance.

Mahua Moitra Slams Modi Government’s Bill, Calls It a ‘Super Emergency’ in India
TMC MP Mahua Moitra launched a sharp attack on the Modi government, terming the proposed Constitution Amendment Bill as a “Super Emergency.” She alleged that the legislation gives the central government unchecked powers to misuse agencies like the ED (Enforcement Directorate) and CBI to target opposition leaders.
Taking to social media platform X, Moitra wrote: “The Opposition’s warnings are turning into reality. With just 240 MPs, the BJP is pushing constitutional changes. This bill sidelines India’s federal structure and judiciary. It allows the central government to arrest opposition chief ministers on fabricated charges and remove them from office without proven guilt. India is under a Super Emergency.”
In another post, she targeted Union Home Minister Amit Shah, stating: “The nation witnessed how Amit Shah could not gather the courage to present this unconstitutional amendment. Even with 20 extra marshals for protection, he sat cowardly in the fourth row. Jo dar gaya, samjho gaya, mar gaya!”

Congress MP Manish Tewari strongly opposed the newly introduced bills, calling them a direct attack on the basic structure of the Indian Constitution. He said, “The fundamental issue is that all three bills go against the core framework of India’s Constitution. According to the rule of law, a person is considered innocent until proven guilty. These bills destroy that foundation by enabling massive misuse of state machinery. This is a violation of Article 21 of the Constitution, which guarantees the right to life and personal liberty.”
AIMIM chief Asaduddin Owaisi also lashed out at the Modi government, terming the move “unconstitutional” and a step toward a police state in India. Speaking in Parliament, Owaisi said, “I oppose the introduction of the Jammu & Kashmir Reorganisation (Amendment) Bill 2025, the Union Territory Government (Amendment) Bill 2025, and the Constitution (130th Amendment) Bill 2025. These legislations violate the principle of separation of powers and weaken the people’s democratic right to elect their own government.”
With strong criticism from opposition leaders, the bills are facing growing backlash for undermining democracy, federalism, and constitutional safeguards.
Criticizing the controversial bill, opposition leaders warned that it gives executive agencies unchecked powers. “This bill allows agencies to act as judge and executioner based on trivial allegations and mere suspicion. It is a direct attempt to turn India into a police state. Amending the Constitution for this purpose will be the death knell for elected governments,” they said.
RJD’s Manoj Jha: BJP’s Weapon to Destabilize Governments
RJD MP Manoj Jha called the bill a political tool of the BJP. He argued, “Wherever the BJP cannot win elections, this law will be used to destabilize governments. The line between accused and guilty has been deliberately blurred. Even the Supreme Court had remarked that the Enforcement Directorate (ED) was being misused for political purposes. Now, through this bill, BJP can frame fake PMLA cases and send anyone to jail.”
Sagarika Ghosh Slams Modi Government: “A Model of Authoritarianism”
TMC leader Sagarika Ghosh has strongly criticized the new constitutional amendment bill, calling it a dangerous step toward authoritarian rule. She said, “Just when people thought Prime Minister Narendra Modi and Home Minister Amit Shah could not cause further damage to the Constitution, they proved otherwise. Two days before the Monsoon Session ended, the Modi government introduced a constitutional amendment that gives the Centre sweeping powers to remove any Chief Minister—even without a chargesheet or conviction. This opens the door for further misuse of enforcement agencies to target opposition Chief Ministers, something Modi’s track record has shown repeatedly over the last decade. This is a shocking and blatant violation of due process, once again exposing the Modi-Shah model of electoral authoritarianism.”
Chaos and Adjournment in Parliament Over Amendment Bill
The introduction of the bill triggered massive uproar in the Lok Sabha. Opposition MPs raised slogans and tore copies of the bill in protest. Amid the commotion, Speaker Om Birla adjourned the House until 3 PM.
Union Minister Kiren Rijiju condemned the opposition’s behavior, saying, “The people elect us to work, not to create disruption. Those who insult democracy will not be forgiven by the people.”
The Constitution (130th Amendment) Bill has ignited a fresh controversy in Indian politics. While the opposition has branded it as the beginning of a “Super Emergency,” the ruling BJP defends it as a necessary step against corruption.
