Delhi HC denies bail to Sisodia, citing his significant influence

The Delhi High Court on Tuesday denied bail to Manish Sisodia in connection with money laundering and corruption cases related to the alleged liquor policy scam. This was Sisodia’s second bail plea in cases filed by the CBI and ED. He remains in judicial custody for both cases.

Justice Swarn Kanta Sharma, in her order, noted that Sisodia was allegedly involved in destroying critical evidence, including electronic records. The court stated, “This court is of the opinion that the petitioner has not been able to make out a case for the grant of bail.” The High Court also highlighted Sisodia’s significant responsibility, overseeing 18 ministries, and his considerable influence within the Delhi government.

Live Law reports that the High Court’s decision said the case shows serious abuse of power and breach of trust by Sisodia. It said the evidence collected in the case shows that Sisodia distorted the process of making the Delhi Excise Policy by manipulating public feedback to suit his goals.

Noting that the corruption stemmed from Sisodia’s desire to frame the liquor policy, Justice Sharma said the AAP leader tried to manipulate the policy making and deviated from the report of the expert committee constituted by him, the court said. The court said that the integrity of the decision-making process was compromised.

The court said Sisodia did not pass the triple test for bail in the CBI case as he failed to produce his two phones and claimed that they were damaged. The court said that the possibility of tampering with evidence by Sisodia cannot be ruled out.

The court noted that the prosecution has assured that the trial will conclude within six to eight months. It stated, “If the trial proceeds negligently or at a slow pace within three months, Sisodia will be entitled to file an application for bail.”

Manish Sisodia, a close aide of Delhi Chief Minister Arvind Kejriwal, was arrested in February last year in connection with an alleged liquor scam and has been in jail since. The Aam Aadmi Party has consistently maintained that Sisodia is not involved in the alleged transaction and is being unjustly detained and harassed. In the last hearing, the court raised a similar question.

In October last year, the Supreme Court directly questioned the ED and CBI, asking, “Where is the evidence against Manish Sisodia? You need to establish the chain of events. Where is the information about the incidents of the crime?”
