Trump will be able to contest presidential election, wins disqualification case in Supreme Court
Former US President Donald Trump has got a big relief. He won the Colorado ballot disqualification case in the US Supreme Court. He is now eligible to contest the presidential elections. Among the Republican candidates, he is considered to be the strongest contender for this post this year and in some surveys, he is even being said to be ahead of the Democrats.
Trump got this relief when the US Supreme Court overturned a judicial decision. An earlier judicial decision had barred him from Colorado’s ballot under a constitutional provision related to insurrection for inciting and supporting the Capitol Hill building attack on January 6, 2021.
On December 19, Colorado’s top court disqualified Trump from the state primary ballot. This made him the first candidate in American history to be deemed ineligible for the presidency due to his involvement in the rebellion. However, Trump has said he will appeal Colorado’s decision to the Supreme Court.
In the month of December itself, after Colorado, another state, Maine, has declared itself ineligible from state primary voting in the US presidential election. The decision was taken by Maine’s top elections official. This made it the second state to impose sanctions on Trump for his role in the attack on the Capitol on January 6, 2021.
The justices unanimously overturned a Dec. 19 ruling by Colorado’s top court that had barred Trump from the state’s Republican primary ballot. Previously the 14th Amendment to the US Constitution had disqualified him from holding public office again. By the way, it was already being said that the Supreme Court has a 6-3 conservative majority and it also includes three judges nominated by Trump.
Section 3 of the 14th Amendment bars from office any United States official who took an oath to support the Constitution of the United States and then rebelled against the same or joined in rebellion, or gave aid to the enemies.
